my child will be 4 in june and he weighs 37 lbs, can he sit in a booster seat using the car seat belt?

North Carolina law states 5 years old AND weighs less
than 40 pounds must be in a CAR SEAT...Both criteria must be met for him to move to a booster seat....this prevents children under 5 from being in a booster seat...Weight criteria was added for children who are 5 or older and still weigh less than 40 pounds....
