It is totally legal. But the people riding in the back must be 18 years of age or older.

It depends on your state. In Florida it is legal under any circumstances if you are over 18.  If you are under 18 it is legal if the cargo bed is enclosed or they are seated and belted.  See www.bedryder.com for more info.
